El complejo de al-Muhaysini: sobre la propagación de la propaganda de los propagandistas

Abstract

This article examines the conviction of the members of the executive board of the Swiss Central Islamic Council for violating the former Article 2, paragraph 1, of the Federal Act banning the groups “Al-Qaeda” and “Islamic State” as well as related organizations. Through the production and dissemination of an interview with the spiritual leader of the Syrian organization Jaysh al-Fath (translated as Army of Conquest), along with a documentary, they deliberately propagated material in support of Al-Qaeda. The aim of this contribution is to concretely illustrate the shift towards a preventive criminal law that has emerged in the context of counterterrorism efforts, characterized by the strengthening of preventive legal models. The article also addresses the tensions arising from this approach, particularly the problematic proximity between the incriminated acts and the offenses committed by the proscribed organization.
